Welcome to Creations by Mystic Pearl. These Terms & Conditions apply when you use our website or purchase goods and services from us.

Please read them before placing an order. Nothing in these Terms & Conditions affects your statutory rights as a consumer.

1. About Us

Creations by Mystic Pearl is a UK-based independent jewellery business offering jewellery, pearls, crystals, accessories, bespoke and made-to-order pieces, jewellery bundles and interactive jewellery reveal experiences.

2. Our Products

We aim to describe and photograph our products as accurately as reasonably possible.

Many of our pieces contain natural pearls, crystals, gemstones and individually selected materials. Natural variations in colour, shape, size, surface texture, pattern and markings are normal and form part of the character of these materials.

Colours may also appear slightly different depending on lighting, photography and your device display.

Where a product photograph represents a style or example rather than the exact item supplied, this will be made clear where appropriate.

3. Plated & Fashion Jewellery

Some products are sterling silver, while others may use plated metals, stainless steel or other materials. The relevant product description will identify the materials where applicable.

Plated jewellery naturally wears over time. Exposure to water, perfume, cosmetics, chemicals and prolonged moisture can accelerate this process.

Please follow the jewellery-care information supplied on our website.

4. Placing an Order

When you place an order, you confirm that:

  • the information you provide is accurate and complete;
  • you are legally capable of entering into the purchase;
  • you are authorised to use your selected payment method; and
  • you have reviewed the product information relevant to your purchase.

Submitting an order does not necessarily mean that we have accepted it.

We may refuse or cancel an order where reasonably necessary, including where:

  • payment cannot be authorised;
  • an item is unavailable;
  • there is an obvious pricing or listing error;
  • we cannot fulfil the order;
  • we reasonably suspect fraud or misuse; or
  • accepting the order would breach a legal or payment-provider requirement.

If we cancel an order after taking payment and no goods are due to be supplied, the appropriate amount will be refunded.

5. Prices & Payment

Our base store prices are set in Pounds Sterling (GBP).

Where our website offers another display/payment currency, converted prices may be calculated using current exchange rates and applicable rounding rules.

Payments are processed securely by the payment methods made available at checkout, which may include WooPayments, card payments, Apple Pay, Google Pay and PayPal.

Availability of individual payment methods may vary by customer, device, location, currency or order.

If we are not VAT registered, prices do not include a separately charged UK VAT amount.

6. Stock & Availability

Products are subject to availability.

Some jewellery is handmade, one-of-a-kind or produced using components available only in limited quantities.

Adding an item to your basket does not permanently reserve it.

Where an item becomes unavailable after an order has been placed, we will contact you and offer an appropriate alternative where suitable or issue the appropriate refund.

7. Bespoke, Personalised & Made-to-Order Jewellery

Some products may be made, altered or personalised specifically for you.

Before bespoke work begins, we may agree details such as materials, design, sizing, personalisation, price and estimated completion time.

Goods that are made to your specifications or clearly personalised may be excluded from the statutory change-of-mind cancellation right where the applicable legal exception applies.

This does not affect your rights if goods are faulty, damaged, not as described or otherwise fail to conform to your statutory rights.

Simply producing a standard item after an order is received does not necessarily make that item personalised or bespoke.

8. Jewellery Reveals

Some Mystic Pearl products include an interactive Reveal experience.

A Reveal is the presentation or selection method associated with physical merchandise purchased by the customer.

Where applicable:

  • the product page identifies the physical merchandise or product category being purchased;
  • the customer receives the guaranteed physical goods described for that product;
  • the reveal may determine or present a listed design, pearl, crystal, colour, style or variation;
  • there are no empty or losing outcomes where the product is described as containing guaranteed physical merchandise; and
  • the customer is purchasing the physical merchandise rather than paying a separate fee to enter a competition.

The individual product description forms part of the purchase information and explains what is included.

9. Reveal Bundles

A Reveal Bundle contains multiple physical products or Reveal experiences as described on its product page.

Where a bundle specifies a guaranteed number of items, categories or minimum value, those commitments form part of the product description.

Some bundles may allow customers to select from eligible Reveal experiences.

For example, where the Mystic Pearl Discovery Bundle is offered, the customer selects the required number of different eligible experiences and the applicable bundle discount is calculated as described on the product page.

10. Live, Personalised Video & Open at Home Orders

Where available, customers may be asked how they would like their order fulfilled or revealed.

Options may include:

Next Live

The purchased items may be presented or revealed during an upcoming Mystic Pearl live stream.

Personalised Video

The purchased items may be presented or revealed in a recorded video prepared for the customer.

Open at Home

Eligible goods are sent for the customer to open or reveal themselves.

Open at Home is currently available to UK customers only.

The selected presentation method does not reduce the quantity of physical goods purchased.

Where a customer asks us to begin personalised work or alteration of goods, any effect on cancellation rights will be determined in accordance with applicable consumer law.

11. Shipping & Delivery

Available delivery services and their prices are shown at checkout.

Delivery times are estimates and may be affected by circumstances outside our reasonable control, including postal disruption, customs processing and international carrier delays.

Customers are responsible for providing a complete and accurate delivery address.

Please contact us promptly if you discover an address error.

12. Delivery Compensation

Some Royal Mail services provide different maximum levels of compensation in the event of eligible loss or damage.

Where the merchandise value of an order exceeds the stated compensation level of the selected delivery service, our checkout may display a warning and recommend a service providing sufficient compensation.

Customers may be offered alternative delivery services with higher compensation limits.

The availability and payment of compensation remain subject to the relevant carrier’s terms and eligibility requirements.

13. International Orders

International customers are responsible for ensuring that products can lawfully be imported into their destination country.

International orders may be subject to customs duties, import taxes, fees or other charges imposed by authorities or carriers.

Unless expressly collected by us at checkout, such charges are normally the customer’s responsibility.

Delivery may be delayed by customs procedures outside our control.

14. USA Customs & Handling Deposit

For applicable orders shipped to the United States, we may collect a provisional USA Customs & Handling Deposit at checkout.

The deposit is a provisional payment towards applicable customs, duties and handling costs and is not necessarily the final charge.

Once the completed parcel is prepared, final applicable charges may be calculated using Royal Mail Click & Drop or another appropriate shipping service.

Where the final applicable amount exceeds the deposit already collected, we may send the customer a payment request for the outstanding balance.

An affected USA order may remain On Hold and will not be dispatched until any required outstanding balance has been paid.

Where orders are combined or held for combined dispatch, charges may be calculated using the final combined parcel.

15. Returns, Cancellations & Refunds

Cancellation, return and refund rights are explained in our separate Refund & Returns Policy.

That policy forms part of these Terms & Conditions.

For most standard online purchases, statutory cancellation rights may apply. Different rules may apply to genuinely personalised or bespoke goods and certain sealed goods where a statutory exception applies.

Nothing in these Terms limits your rights in relation to faulty, damaged, incorrect or misdescribed goods.

16. Faulty or Damaged Goods

If goods arrive faulty, damaged, incorrect or not as described, please contact us as soon as reasonably possible:

We may request photographs to help us assess the problem.

Depending on the circumstances and your statutory rights, an appropriate remedy may include repair, replacement, price reduction or refund.

There is no 48-hour deadline that removes your statutory consumer rights.

17. Jewellery Care

Customers should follow the jewellery-care information supplied with products or displayed on our website.

Unless a product is specifically described as suitable for such exposure, we recommend avoiding:

  • water and prolonged moisture;
  • perfume and cosmetics;
  • harsh chemicals;
  • swimming and showering while wearing jewellery; and
  • unsuitable storage conditions.

Normal wear, accidental damage or deterioration caused by inappropriate care is different from a manufacturing fault.

18. Website Content & Intellectual Property

Unless otherwise stated, the branding, original photographs, graphics, written content, logos and original designs displayed on this website are owned by or licensed to Creations by Mystic Pearl.

They may not be copied, reproduced, republished or commercially used without permission, except where permitted by law.

19. Portfolio

Our Portfolio showcases examples of previous Creations by Mystic Pearl work.

Portfolio pieces may no longer be available.

Because pearls, crystals, gemstones and individual components may be unique or available only in limited quantities, an exact reproduction of a previous piece cannot always be guaranteed.

20. Our Responsibility to You

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot legally be excluded under consumer protection law.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for losses arising from circumstances outside our reasonable control, except where the law provides otherwise.

Nothing in these Terms excludes your statutory rights.

21. Events Outside Our Reasonable Control

We are not responsible for delays or failure to perform caused by events outside our reasonable control.

This may include postal disruption, carrier delays, customs delays, severe weather, system outages, supplier disruption or other comparable events.

Where such an event materially affects an order, we will take reasonable steps to communicate with you and minimise disruption.

22. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our products, website, payment methods, business practices or legal requirements.

The version applicable to an order will normally be the version published when that order was placed.

23. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the UK, you may also benefit from mandatory consumer protections and rights to bring proceedings in the courts applicable to where you live.

Nothing in this section removes rights that cannot legally be excluded.
